Autonomous vehicles crashing the law? A prospective study of civil liability and - compensation implications under Belgian, French, UK/English and EU law provides a clear understanding of the operational and technological eco-system surrrounding autonomous vehicles. It maps the different actors and technological components that may have a role in the occurence of an accident involving a self-driving car.
Analysis of existing civil liability and compensation laws
This book then provides a clear and thorough analysis of the fitness of existing civil liability and compensation frameworks which may be implemented in the context of autonomous vehicle accidents. It assesses Belgian, French, UK/English and EU law. Traffic compensation laws, fault liability, liability for things, product liability and insurance laws are assessed against these vehicle’s disruptive characteristics. This analysis leads to the identification of certain legal hurdles.
Exploration of potential legislative evolutions
Based on a specific evaluation methodology, and in light of the identified legal hurdles, this book analyses existing proposals for legislative evolutions. It also explores new legislative approaches.
About the author
Orian Dheu holds a PhD in law from KU Leuven. He received funding from the European Union through the Marie Skłodowska-Curie PhD network ‘Safer Autonomous Systems’ to conduct research on the legal implications of the development and deployment of autonomous systems. He was a research associate at KU Leuven's Centre for IT and IP Law (CiTiP). His expertise includes liability and transport law, as well as ICT law.
He also obtained a specialised master's degree in aviation law and management from Aix-Marseille University, as well as a master's and bachelor's degree in law from Université Paris 1 Panthéon-Sorbonne (France).
